MunchMart Platform (User App & Partner App)

1. INTRODUCTION & PARTIES

These Terms and Conditions ("Terms") are entered into between MunchMart Foods, a company having its registered office at Gurugram, Haryana (hereinafter referred to as "MunchMart", which expression shall, unless repugnant to the context or meaning thereof, include its successors, administrators, legal representatives, and assigns), of the First Part,

AND

Users of the MunchMart Café App ("User"), and

Café / Restaurant Partners onboarded on the MunchMart Café Partner App ("Partner"),

collectively referred to as the "Parties" and individually as a "Party".

These Terms govern access to and use of the MunchMart platform, including all applications, features, services, and functionalities provided therein.

2. DEFINITIONS

• App / Platform: The MunchMart Café App and MunchMart Café Partner App operated by MunchMart.
• User: Any individual accessing or placing orders through the App.
• Partner: Any café, restaurant, or food outlet listed on the platform.
• Order: A confirmed food purchase request placed by a User.
• Services: Food discovery, ordering, facilitation, delivery coordination, and related services.
• Affiliate: Delivery partners or third-party service providers engaged by MunchMart.

3. NATURE OF PLATFORM

• MunchMart is a technology platform only.
• MunchMart does not prepare, cook, sell, package, or inspect food.
• All food-related responsibilities lie solely with the Partner.
• MunchMart does not guarantee food quality, hygiene, delivery time, or availability.

4. USER ELIGIBILITY

For Users

• Must be 18 years or older or have valid parental/guardian consent.
• Must provide accurate and complete information.
• Are responsible for maintaining confidentiality of login credentials.

For Partners

• Must provide accurate, valid, and updated business details.
• Must operate in compliance with FSSAI, GST, and applicable local laws.
• Are solely responsible for business legality and operations.

5. ACCOUNT REGISTRATION & REQUIREMENTS

Account Requirements

To use the MunchMart Café Partner services, users must provide a valid mobile phone number. This number is essential for the fulfillment of orders and communication between the café and the user.

• Your mobile phone number is a primary identifier for your account.
• By providing your number, you consent to receive transactional communications related to your orders.
• This number enables our café staff to contact you regarding order status, availability issues, or delivery updates.
• Failure to provide a valid mobile number may result in the inability to process orders or maintain an account.

6. LOCATION-BASED SERVICES

The App may use location data to:

• Display nearby cafés
• Determine service availability
• Calculate delivery feasibility

Location data:

• Is accessed only when required
• Is not continuously tracked in the background
• Can be disabled, though functionality may be limited

7. PRICING & FEES

• Food prices are determined solely by Partners.
• Platform fees, delivery charges, and taxes may be displayed.
• MunchMart may modify platform-related fees at its discretion.

8. ORDERS & PAYMENTS

• All orders are subject to Partner acceptance.
• Menu availability, preparation, packaging, and pricing are Partner responsibilities.
• Payments must be made using supported payment methods only.
• MunchMart does not store sensitive payment information.

9. CANCELLATION POLICY

Users

• Orders cannot be cancelled once accepted unless otherwise specified.
• Incorrect order details are the User's responsibility.

Partners

• Partner-initiated cancellations after acceptance may attract penalties.
• Repeated cancellations may result in suspension or termination.

10. REFUND POLICY

Refunds may be initiated in cases of:

• Non-delivery
• Incorrect items
• Verified quality issues

Refunds:

• Are subject to Partner verification
• Follow payment gateway timelines
• May be deducted from Partner settlements where applicable

11. DELIVERY, PICKUP & HANDOVER

• Delivery times are estimates only.
• Delays caused by Partners or Affiliates are beyond MunchMart's control.
• Users must provide accurate delivery details.

Partners must ensure:

• Proper packaging
• Timely preparation
• Sealed and correct handover

12. FOOD SAFETY & ASSUMPTION OF RISK

• Food consumption carries inherent risks including allergies.
• Users must independently verify ingredients and allergen details.

Partners are solely responsible for:

• Food safety
• Hygiene
• Quality

13. DOCUMENTATION

• The platform currently does not require document uploads from Users or Partners.
• Partners remain responsible for legal compliance.
• MunchMart may request documents in the future for regulatory or platform integrity reasons.

14. USER & PARTNER CONDUCT

Users and Partners must not:

• Engage in abusive, fraudulent, or illegal activity
• Manipulate orders or data
• Misuse reviews or feedback
• Attempt to hack or disrupt the platform
• Divert customers outside the platform

15. PENALTIES

MunchMart reserves the right to:

• Restrict access
• Suspend or terminate accounts
• Impose penalties
• Deduct amounts from Partner settlements
• Take legal action where required

16. TERMINATION

MunchMart may suspend or terminate access without prior notice in cases of:

• Policy violations
• Fraud
• Legal or regulatory requirements
• Repeated complaints or misuse

17. INDEMNIFICATION

Users and Partners agree to indemnify and hold harmless MunchMart from:

• Misuse of the platform
• Breach of these Terms
• Food safety violations
• Legal claims
• Third-party disputes

18. LIMITATION OF LIABILITY / DISCLAIMER

MunchMart shall not be liable for:

• Food quality or hygiene issues
• Delivery delays
• Allergic reactions
• Partner or Affiliate actions
• Indirect or consequential damages

19. ALCOHOL & RESTRICTED ITEMS

• Sale of restricted items must comply with applicable laws.
• MunchMart may disable such listings at its discretion.

20. GOVERNING LAW & JURISDICTION

These Terms shall be governed by the laws of India.

Courts at Delhi shall have exclusive jurisdiction.

21. MODIFICATION

• MunchMart reserves the right to modify these Terms at any time.
• Continued use of the platform constitutes acceptance of updated Terms.

22. FEEDBACK

• Users and Partners may provide feedback through the App.
• Misuse of feedback systems may result in account action.
